Put super-genius-deity Kevin Pritchard behind bars!

(if it's a jailable offense)

In a story posted April 14 on the Portland Tribune’s Web site, Pritchard said, “The doctors had actually said, ‘If you were my son, I’d never have you pick up a basketball again.’ I’m the kind of GM (that) I wouldn’t want that on my head that he ever had to have knee replacement.”

The problem for Pritchard and the Blazers is that those statements could be a violation of the privacy provisions of the Health Insurance Portability and Availability Act of 1996 (HIPAA). Since the HIPAA privacy rule went into effect on April 14, 2003, pro and college teams in all sports have been very reluctant to reveal specific details of player injuries without the permission of the player.

At the very least, this should discourage Pritchard's future public comments regarding Greg Oden's and Brandon Roy's debilitating injuries.

i don't know the exact laws

as in what the punishments are etc.

but i worked in healthcare for several years and i agree that his comments are totally inappropriate. there’s a reason that HIPAA exists. no one other than the patient is supposed to have the right to release any info and he shouldn’t be saying stuff like that.

two 10 day contracts is a small price to pay in order to kneecap your opponents cap room for a few years.

Is at least a month, which means its more than two 10 day deals which means his deal will be GUARANTEED, and Miles is a multi-year veteran so his minimum starts at a million bucks.

So, if someone signs him, it’ll be because he’s healthy, not to screw over the Blazers.

The Blazers had cap space before the Miles retirement. The enemy team will have to have a roster spot, be willing to pay Darius Miles 1 million bucks and actually play him 10 games (not 10 days), and have to really hate the Blazers.

And for all of that trouble, the Blazers have just UNDER the max amount to offer a free agent, instead of 25 million or so. The Miles retirement savings was just gravy, the real cap space room comes from the Raef Lafrentz and Steve Francis’ expiring contracts.

I seriously doubt anyone signs Miles unless he is healthy, and if he is he will be the 1st person in NBA history to come back after independent doctors deem an injury to be career ending. It isn’t likely.

I hope for Miles sake he can come back. Career ending injuries are no fun.

KP has a good relationship with Miles’ agent, and while he might have overstepped his bounds with what he can say I doubt he’ll get in much trouble. The reasons for his retirement aren’t completely closed off from the public, and was verified and agreed upon by the NBA, the Players Union, and independent doctors.

KP should just not talk, of course. Does no good either way.

I have no link, but my understanding also sez that even if Miles comes back and plays healthily in 10 games, the money does not automatically go back on the cap.

The Blazers can appeal the money being put back on, and since the Miles injury is real and the due process was done correctly in determining the injury was career ending, it isn’t likely to be agreed that the Blazers let a healthy player go and pretended he was injured.

And by the time all that happens, the cap space window is over with, and the Blazers used the cap room. No takesies backsies. Worst case scenario, Paul Allen pays a bit more instead of insurance footing the bill.

Either way, the Blazers still use the cap space.

The Miles situation doesn’t matter as far as the Blazers franchise goes, and I sincerely hope he comes back healthy. He’s far too young and far too talented to have such a wasted career. I believe the docs though… he’s probably finished.

don’t rub it in (any more). Do you mind if we laid claim to MJ as an honorary Blazer? He may have never worn the Jersey, but it was our stupidity that vaulted Chicago to dynasty status. Besides, the saying “there’s more than enough to go around” was tailor-made for MJ.

Probably not jailable.

Most administrative or privacy laws just lead to fines or private causes of action for damages. But if the fine is big enough, and we could time warp back to the 1700s, we could throw him in debtor’s prison.

I think that there should be an implied exception to HIPAA for professional athletes. They are public figures whose main value to the cities and fans that support them (pay their salary and the rent on their gym) is the condition and ability of their body. If the injury is classically sports-related, I don’t think the divulging of details should be a violation of privacy. Now, if it’s cancer or something not caused by the guy playing basketball (or whatever sport), the law should apply in their capacity as a non-public figure.

And I wasn’t saying the Bulls would (obviously) or should do that move. Bayless would be sort of duplicative of Gordon, he’s definitely not a “pure point guard,” and he’s not a good fit at all with the Bulls. However, I think he is a better fit than Rose with the Blazers’ core – they have plenty of guys to create their own shot, and really need more of a scorer/shooter playing next to Roy. (And yes, although I realize it’s against conventional wisdom, I do think Bayless will be the better pro.)

Rose has a better chance of being the kind of “pure point guard” who creates opportunities for athletes like Noah and Thomas, and he’s got a chance to be great (based on athleticism and attitude – but not, at this point, skill level), so the Bulls have no choice but to go all-in with him and hope it happens.

Bayless isn't the second coming of Jordan.

Other Miles news

He tested positive for a banned substance. True Hoop did a speculative post on the test when it was announced fingering marijuana.

The substance was an appetite suppressant.

It may be less expensive for the Blazers to eat his contract, hope Miles gets two 10 day deals, and gets back to the NBA because the alternative is going to cost about the same, but just for the lawyers.

Cost schmost

That cost exists outside the salary cap.

The Miles salary going back on the cap exists ON the salary cap. That’s the only cost that matters.

10 Million in legal fees is nuthin’, 10 million on the salary cap can be everything.

Ok: Darius is suspended for 10 games. He needs to play 10 games to go back on the Blazers books (and even then, it’s a MAYBE—it’s not automatic, the league reviews the circumstances). That means he needs to play on a team for TWENTY games, which is a quarter of a season.

That means he will need much more than two 10 day contracts—even if he wasn’t suspended, no one plays 10 games in 20 days, so two 10 day deals isn’t enough.

NBA teams can’t sign someone for more than two 10 day deals, so his deal becomes guaranteed.

As a veteran, his minimum is at a million bucks. That’s a lot of cost, both financially and to the locker room (plus keeping a roster spot open and all), just to MAYBE kick the Blazers in the nuts, provided the leaue agrees that the Blazers cut Miles when healthy (which they likely don’t since the league agreed to it).

PLUS, on top of that, the kick to the nuts would miss even if Miles goes back on the cap because the Blazers still have ~15 million in cap space (probably just under what a max deal would be).

So, if a team does this, it will be because they like Miles, which is why a team should put him on their roster. It doesn’t hurt the Blazers enough at all, since they were set up for cap room back when we were waiting for Miles to come back healthy. His cap room is just gravy.

I was a fan of Dr. Darius and I hope he makes it all the way back with someone…

This is one thing I can't follow ya on

They treated him shabbily by hiring him a trainer, having him work with coaches daily and work out daily, get him a personal chef paid by the team to get him in shape, and did all this for two YEARS waiting for him to get healthy?

It’s not like he wasn’t in the practice facility every day. That was always reported.

Darius tried to come back and the Blazers reportedly tried to help in all the ways a franchise can do.

Steve Francis never even arrived in Portland. Darius was working with coaches and trainers daily. Not exactly the same, and I don’t get why you think there is a Darius Miles conspiracy that is being hidden. They gave regular reports that he was working hard, trying to get healthy, the normal crap. What do you imagine was hidden?

I hope he gets healthy and becomes the 1st ever to come back from career ending injury. He’s so young, so anything could happen.

They had no intention of ever bringing him back...

............................ it was company policy to get him to take medical retirement, getting the bloated salary off the books, the team off the luxury taxpayers’ role, and to keep the clean-cut youngsters away from a perceived “jailblazer” influence.

The team ran a de facto news blackout on his progress (compare and contrast to the way they handled the Oden knee injury).

The team has a great deal to gain if Miles stays out of the league, and their actions are HIGHLY suspect, at a minimum…

To that I would say…..so what? As long as they followed the rules …..their intentions or hopes are irelevent. They followed the rules as set forth in the CBA and then waived him. So what if they kept him away from the rest of the team.

If it’s a basketball related injury the contract he signed already give consent to talk about that injury. By the posters logic, everytime we hear that Derek Rose has tendinitis or Greg Oden had surgery or the test results from x draftees physical indicate a heart condition EVERY GM WOULD BE IN CONTEMPT. I understand that Miles’ may try to sue Pritchard or rather Vulcan sports (deep pockets) for something, and he could get some money, but it’s doubtful as he is still being paid and not actually playing for us. Also, again, Pritchard’s actions may have been in bad form but they aren’t illegal.
